Design Policy / Terms of Use of Templates or Images: (Terms & Conditions)

Design Restrictions:

We reserve the right to refuse any work for any reason.

In Short we will refuse to do any work that is Political, Religious, Libelous, Immoral, Defamatory, Illegal, Racial, Alternative Life Style, Homosexual, Fraudulent, Obscene, Gambling, Violent, Tobacco Related, in violation of copyright laws or anything we deem unacceptable for any reason.

We will not work with the following: Defamatory, pornographic, libelous, immoral, obscene, gambling or fraudulent, or illegal, Sexually explicit or deemed explicit by our company, no violent material will be produced, no political material which would include country flags or anything that would be pertain to or represent politics in anyway, no religious material this includes things such as crosses, crescents, Santa Clause or anything that may be deemed religious in nature regardless whether Christian, Moslem, Buddhist etc.

Our company will not knowingly use material that has been copyrighted by another company unless permission has been granted for / or licensing has been obtained for the works used and we will abide by any terms that the licensing entails.

Photos licensed from another company cannot be used in other projects that the project that was designed specifically by B&G Sales International / Uniquelycyber.com.

IMPORTANT INFORMATION

You read carefully the following Terms and Conditions. Your purchase or use of our products implies that you have read and accepted these Terms and Conditions.

LICENSE

Our website grants you non-exclusive limited license to use the web templates and other products sold through our web site by our staff (the "products") in accordance with these Terms and Conditions (the "license") issued by our company.

a) LIMITED USAGE GRANTED

You may use each individual design / product on a single website only, belonging to either you or your client. You have to purchase the same template once more in order to make another project with the same design.

b) IMAGERY and CLIPART

All imagery and clipart used in our designs / templates are royalty-free and are the integral part of our products. Limited-usage License gives you the right to use images & clipart only as a part of the website you build using your template. You can use imagery & clipart to develop one project only. Any kind of separate usage or distribution is prohibited.

c) MODIFICATIONS

You are authorized to make any necessary modification(s) to our products to fit your purposes.

d) UNAUTHORIZED USE

You may not place any of our products, modified or unmodified, on a diskette, CD, website or any other medium and offer them for redistribution or resale of any kind without prior written consent from our company.

e) ASSIGNABILITY

You may not sub-license, assign, or transfer this license to anyone else without prior written consent from B&G Sales International / uniquelycyber.com.

f) OWNERSHIP

You may not claim intellectual or exclusive ownership to any of our products, modified or unmodified. All products are property of either B&G Sales International / uniquelycyber.com or independent content providers. Our products are provided "as is" without warranty of any kind, either expressed or implied. In no event shall our juridical person be liable for any damages including, but not limited to, direct, indirect, special, incidental or consequential damages or other losses arising out of the use of or inability to use our products.

OUR REFUND POLICY

Since B&G Sales International is offering non-tangible irrevocable goods we do not issue refunds after the product is shipped, which you are responsible for understanding upon purchasing any article at our site. We only make exceptions with this rule when the product appears to be not-as-described on a case by case basis in agreement of the parties concerned. The deadline for any refund claim is one week after the delivery date. The refund is issued to you after we receive a Waiver of Copyright signed by you. This is a required condition.

Permitted Uses.

Back up, and store, single Image(s) as necessary on a single server for archival, tracking or asset management purposes only. Any copy or archive you make must include copyright notice.

Use the Image(s) in any electronic or print media, including advertising and editorial use, provided such use is not intended to allow the re-distribution or re-use of the Image(s).

Use the Image(s) in any items for personal use or resale, including book covers, calendars, consumer merchandise (T-shirts, posters, art, etc.), provided such use is not intended to allow the re-distribution or re-use of the Image(s).

Modify or alter the Image(s) as necessary for your use, provided that if such modification or alteration constitutes a derivative work, the rights to all such derivative works shall belong exclusively to B&G Sales International, as the case may be, - and that you shall only use such derivative work in accordance with this Agreement. If requested by B&G Sales International, you agree to execute a written assignment of any such rights, including copyrights, at no cost to B&G Sales International.

Use the Image(s) as décor in an office, lobby, public area, restaurant, or retail store.

Use the Image(s) as design elements in video, film, or television broadcasts.

Use the Image(s) in connection with your business or entity, e.g. corporate identity documents and letterhead, except as prohibited below.

Use the Image(s) for any other uses approved in writing by B&G Sales International.

Prohibited Uses: You may NOT:

Sublicense, distribute, transfer or assign the Image(s) or rights to the Image(s).

Reverse engineer, decompile, translate, or disassemble any part of the Image(s).

Remove any copyright, trademark or watermark from any place where it appears on the Image(s).

Display the Image(s) in any digital format or for any digital use at a resolution greater than 72 dpi, except in editorial or preliminary design work. Doing so will be viewed as an attempt to distribute the Image(s) in violation of this Agreement.

Use the Image(s), or any part of the Image(s), as part of a trademark, service mark, or logo. B&G Sales International retain the full rights to the Image(s), and therefore you cannot establish your own rights.

Use the Image(s) to compete with B&G Sales International. B&G Sales International is in the business of licensing images to its customers. It is the specific intent of this provision to prohibit you from using the Image(s) to enter, either directly or indirectly, a similar or competing business.

Use the Image(s) in a product or service whereby the Image(s) can be used apart from a product or service.

Use the Images(s) in any downloadable format intended for multiple distribution including, without limitation, Web site templates, software products, e-greetings, etc. You may contact support @ bgsales.com to find out about a special license for such use.

Use the Image(s) in any way that could be considered defamatory, pornographic, libelous, immoral, obscene or fraudulent, or illegal, either by making physical changes to it, in the juxtaposition to accompanying text or images, or otherwise.

Use Image(s) as part of any use involving sensitive subject matters, as determined by B&G Sales International, including but not limited to the following: all sexual issues, sexually transmitted diseases, substance abuse, alcohol, tobacco, AIDS, cancer, mental ailments, Homosexual or alternative lifestyles, and physical or mental abuse, will be prohibited by B&G Sales International. Sensitive subject use pertains to both commercial and editorial uses.

Additional Terms

B&G Sales International reserves the right to (i) not permit use of any Image(s) for any reason whatsoever; and (ii) notify you that certain Image(s) are no longer available for use. Upon such notification, the license to use such Image(s) shall automatically and immediately terminate.

All other rights not expressly granted to you are reserved solely for B&G Sales International.

B&G Sales International requests the copyright notice "© [insert current year] B&G Sales International" appear adjacent to the Image(s) or on a credit page.

B&G Sales International reserves the right to replace Image(s) with an alternative Image for any reason. Upon notice of such replacement, the license for the replaced Image(s) immediately, and automatically, terminates for any use of the Image(s) that does not already exist, and this License Agreement shall automatically apply to any replacement Image(s). You agree not to use any replaced Image(s) with future products or services and you shall take all reasonable steps to discontinue use of the replaced Image(s) in existing products or services.

PRIVACY Policy:

Our privacy policy fully complies with the Canadian government's new privacy legislation, the "Personal Information Protection and Electronic Documents Act" and incorporates the protections of the Canadian Standards Association's "Model Code for the Protection of Personal Information".

Why Do We Need Your Personal Information?

You may visit our website without providing us with any information. We do however require information from you in order to provide you with satisfactory customer service. We require this data for the following uses:
